Registering a company logo gives you full ownership of your company logo. Therefore, businesses should proactively register their logo copyright as soon as possible to avoid copyright theft. Many companies spend a lot of money to build a brand identity, including a company logo, but forget to register the copyright, and then their competitors register for protection first, leading to many funny situations.

According to current regulations and practical application of company logo registration, there are 2 forms of company logo protection. And each form will have different documents and procedures for company logo registration.

Register logo protection as a trademark

Step 1  Perform a company logo lookup

Before registering a company logo, customers send the logo to be registered along with information about the group of goods and services (industry, field of operation) to the email address: hello@henrylincoln.co; HLA's consultants will conduct a free search and evaluate the logo's ability to be protected for you.

Step 2 Prepare documents to register company logo

  • Proposed logo sample for protection registration: In the form of stylized images or letters.

  • Company logo registration form according to current regulations.

  • Authorization letter from the applicant for HLA to submit the application.

  • Regulations on the use of the logo if the logo is registered as a collective trademark.

  • Wills, assignment contracts, employment contracts, and decisions on assignment of work on confirmation of the right to submit a valid application.

  • A copy of the first filed application if priority is claimed in the application.

  • Certificate of origin if the logo contains information relating to the country of origin.

Note:  The registration of a company logo is based on the group of goods and services that the enterprise registers; The group of goods and services that the enterprise registers is classified according to the Nice Agreement 10. Enterprises should pay attention to this issue to choose the registration group to avoid confusion and automatically register all industries listed on the business registration certificate.

Step 3  Submit and track logo copyright registration application

  • The application form is printed in 02 copies, signed and stamped by the applicant and submitted to the Intellectual Property Office. The Office keeps 01 copy and 01 copy stamped by the Office with the date of receipt of the application and the application number is sent back to the applicant. If the application is submitted through an industrial property representative, the industrial property representative will sign.

  • After 02 months, there will be a notice of acceptance of the application as valid in form or a notice requesting amendments to the registered application. In case of amendments to the application, the enterprise must note that it must not change the nature of the originally registered subject (do not change the registered industry group).

  • After 9 months from the date of notification of formal acceptance of the application; the Intellectual Property Office will notify whether or not to grant a protection certificate. If the certificate is refused, the enterprise has 3 months from the date of receipt of the notification to draft a complaint requesting reconsideration of the protection certificate.

  • After 2-3 months of receiving the notice of granting a protection certificate, the enterprise pays the certificate granting fee to receive the official protection certificate.

Register your company logo as copyright

Step 1:  Assess the possibility of being granted a certificate of copyright registration

After receiving your logo, Luat Viet Tin's intellectual property specialist will evaluate the possibility of being granted a Copyright Registration Certificate. Then, the customer will be given feedback on the results to decide whether to proceed with the registration procedure or not.

Searching and evaluating under this form of copyright is more difficult than evaluating and searching under the form of trademark registration. Because currently, the Copyright Office does not have any database to conduct searches for logos under review. There is only a search database for works that have been granted a Certificate of Copyright Registration.

Step 2:  Complete the procedures and documents to apply for a certificate of copyright registration for the company logo.

Logo registration file includes

  1. Copy of Business Registration Certificate if Company is the owner.

  2. Author's identity card or citizen identification card (in case the author is not also the owner).

  3. Decision on assignment of tasks (in case the author is not also the owner).

  4. 02 color printed logo copies (clearly printed on A4 paper).

  5. Author's guarantee: I guarantee that the logo is my own creation and not copied from anyone else.

  6. Authorization letter from the company/individual for Luat Viet Tin to perform the registration.

  7. Copyright registration form.

Note: The file is made into 01 copy; 01 copy is kept by Luat Viet Tin to track the file, 01 copy is submitted to the Copyright Office to apply for a license. If the owner is a company, the legal representative of the company must sign and stamp. If the owner is an individual, just sign and state full name.

The application is submitted to the Copyright Office. After 15 working days, the Office will issue a certificate of copyright registration for the company logo if the application is valid.

Step 3 Track the status of your company logo copyright registration application

If the application does not meet the requirements for amendments and supplements. Valid applications will be announced for copyright registration; Issue a Certificate for the registered logo.

Step 4 Receive the Certificate of Copyright Registration and transfer it to the customer.

Registering a company logo as a trademark

Advantage

  • Broad and detailed protection scope for each specific goods and services.

  • Ensure the difference between the goods and services of the company doing business. Create an impression for consumers that does not cause confusion with other companies.

  • The owner has the right to renew the logo that has been granted protection in the form of a trademark. The number of times the certificate can be renewed is unlimited.

  • The ability to prevent infringement is higher than registering as a copyright. Just confusingly similar or identical to a registered trademark will be refused a patent.

  • Protects both the content and form of the logo.

Disadvantages

  • The time to register for a certificate is long. During the waiting process for the official certificate to be approved, the enterprise cannot actively promote the registered trademark. Because during the examination process, the application may be refused to grant a certificate of protection.

  • The protection period is short and the owner must always pay attention to renewing the certificate. If the protection period expires and the owner does not renew, the protection will automatically cease to be valid.

  • The possibility of protection is lower than other forms due to the relatively strict criteria of non-duplication and avoidance of confusion.

Register logo as copyright

Advantage

  • The possibility of being granted a protection certificate is high. For logos with low protection as a trademark, businesses often register them as copyrights.

  • The time to apply for a certificate is short. For businesses that need a legal basis for early business operations, they can choose this form of registration.

  • The validity of a copyright registration certificate is long-term, 50 years after the author's death. It is an inheritance for future generations.

Disadvantages

  • Registering a logo as copyright is only protected in terms of form, only the difference can be protected. Therefore, the ability to create a difference from other logos is not high.

  • For companies, there must be a decision assigning tasks to the author. When carrying out the registration procedure, it is necessary to clearly distinguish between the owner and the author. To grant a certificate of protection without causing confusion.

In practice, a company logo is often required to be searched before registering for protection as a trademark. If the logo is confusing or similar, the customer will be required to move towards copyright registration in order to be protected in terms of form.
